Cross-Border Data Transfer Mechanisms

As part of our marketing services at Tyler Hampshire Ltd, we may transfer personal data to third-party service providers or partners outside of the United Kingdom. In doing so, we are committed to ensuring that your personal data is adequately protected in compliance with UK General Data Protection Regulation (GDPR).

How We Ensure Your Data is Protected:

  1. Transfers to Countries with Adequacy Decisions: If we transfer your data to a country that has been deemed to provide an adequate level of data protection by the UK government, we rely on that adequacy decision as the legal basis for the transfer. This means that your data will receive a similar level of protection as it does within the UK.
  2. Standard Contractual Clauses (SCCs): For transfers to countries without an adequacy decision, we ensure that your data is protected by entering into agreements based on the UK GDPR Standard Contractual Clauses (SCCs) with the recipient. These clauses impose contractual obligations on the recipient to protect your data to the same standards as required by the UK GDPR.
  3. Binding Corporate Rules (BCRs): In cases where data transfers occur within our group of companies or to specific business partners with approved internal data protection policies, we rely on Binding Corporate Rules (BCRs). These rules have been approved by the UK Information Commissioner’s Office (ICO) and guarantee that your data will be treated with the same level of protection regardless of where it is processed.
  4. Derogations for Specific Situations: In rare cases, we may transfer your data based on specific situations, such as when you have explicitly consented to the transfer after being informed of the risks, or when the transfer is necessary for the performance of a contract between us and you, or for important reasons of public interest.

Your Rights Regarding Cross-Border Transfers:

  • You have the right to request more information about the safeguards we have in place for cross-border data transfers.
  • You may also request a copy of the Standard Contractual Clauses (SCCs) we use to protect your data during such transfers.

Ensuring Transparency: We will always inform you if your data is being transferred internationally and ensure that appropriate mechanisms are in place to safeguard your personal data.

For more information or if you have any questions about how your data is handled in cross-border transfers, please contact our Data Protection Officer at dpo@tylerhampshire.uk
